Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the ETIKETTA website and our label design services (collectively, the "Service"). By accessing the Service, placing an order, or creating an account, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Service.

2. Description of Services

ETIKETTA provides professional label design services including:

• Visual concept development
• Complete label design packages
• Premium design packages with source files
• Print-ready production files
• Brand consultation services

All services are delivered digitally via download links or secure file transfer.

3. Orders and Payment

3.1 Order Process

• Orders are placed through our Shopify store
• Full payment is required upfront for all services
• Project brief must be completed within 48 hours of purchase
• Work begins only after receiving complete project information

3.2 Pricing and Payment Terms

• All prices are in USD and exclude taxes
• Payments processed via Shopify Payments (PCI compliant)
• No refunds after project initiation (see Refund Policy)
• Express service available at 50% additional fee

4. Delivery Timeline

• Visual Concepts: 3-5 business days
• Complete Design: 7-10 business days
• Premium Package: 10-14 business days
• Express Service: 50% faster (additional 50% fee)

Timeline begins after complete project brief submission. Delays in client feedback extend delivery dates proportionally.

5. Revisions Policy

5.1 Included Revisions:

• Visual Concepts: 1 round of feedback
• Complete Design: 2 rounds of revisions
• Premium Package: Unlimited revisions until satisfaction

5.2 Revision Guidelines:

• Revisions must be requested within 7 days of delivery
• Major scope changes require new purchase
• Additional revisions: $99/hour beyond package limits

6. Intellectual Property

6.1 Client Materials

You grant ETIKETTA a worldwide, non-exclusive license to use your logos, brand guidelines, and content for the purpose of providing design services.

6.2 Final Designs

Upon full payment and project completion, you receive:

• Full commercial usage rights to final artwork
• Ownership of print-ready files
• Perpetual license for source files (Premium Package only)

6.3 Portfolio Usage

We reserve the right to use completed projects in our portfolio (anonymized if requested) for marketing and demonstration purposes.

7. File Formats and Specifications

All delivered files include:

• CMYK PDF (print-ready, 300 DPI, with bleeds/crop marks)
• AI/EPS vector source files (layered, Premium Package)
• Die-cut lines and spot color separations
• Proof simulations for printer verification

Files are optimized for standard commercial printers. Printer-specific adjustments available upon request.

8. Cancellation and Refund Policy

• Pre-Project: Full refund within 24 hours of purchase
• Project Started: No refunds (custom digital service)
• Non-Delivery: Full refund + free redesign
• Print Issues: Free file revision if our error

9. Client Responsibilities

• Provide complete, accurate project brief within 48 hours
• Supply high-resolution brand assets (logos, guidelines)
• Provide printer technical specifications
• Respond to revision requests within 3 business days
• Verify final files before printing

10. Limitation of Liability

To the maximum extent permitted by law:

• ETIKETTA is not liable for printing errors or production issues
• Our total liability shall not exceed the amount paid for the service
• We are not responsible for client-provided content accuracy
• No liability for indirect, consequential, or punitive damages

11. Termination

We may terminate or suspend access to the Service immediately, without prior notice, for:

• Breach of these Terms
• Non-payment or repeated late responses
• Intellectual property infringement
• Illegal or fraudulent activity

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Doña Ana County, New Mexico.

13. Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, or internet service interruptions.

ETIKETTA reserves the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of changes.
